These terms cover use of this website. Actual project work is governed by the signed proposal or statement of work for that engagement. Last updated: September 4, 2026.
This is a general-purpose template covering the common points a software and SaaS development company needs to address. It is not legal advice — have it reviewed by a qualified lawyer for your jurisdiction before relying on it.
These Terms of Service ("Terms") govern your use of buildstacksoftware.com (the "Site"), operated by BuildStackSoftware ("we", "us", "our"). By using the Site, submitting a consultation request, or engaging our services, you agree to these Terms. If you don't agree, please don't use the Site.
We provide website, custom software, web application, e-commerce, SaaS, mobile app and API/integration development services, along with related consulting and support. Content on this Site — including service descriptions, case studies and pricing indications — is for general information and does not itself constitute an offer or a binding quote.
You agree to use the Site only for lawful purposes and not to: attempt to gain unauthorized access to our systems; interfere with the Site's normal operation; scrape or copy Site content for commercial redistribution; or submit false or misleading information through our forms.
Submitting the contact form or requesting a consultation does not create a contract between us. A specific project — its scope, deliverables, timeline, fees and payment schedule — is governed by a separate proposal, statement of work or master service agreement signed by both parties. Where these Terms and a signed project agreement conflict on project-specific matters, the signed agreement controls.
Everything on this Site — text, graphics, the BuildStackSoftware name and logo, and the underlying code — is owned by us or our licensors and protected by applicable intellectual property law. You may view and share Site content for personal, non-commercial reference, but not reproduce or reuse it commercially without permission. Ownership of deliverables built for a client project (source code, designs and related IP) is defined in that project's signed agreement, typically transferring to the client upon full payment.
Fees, invoicing schedules and payment terms for a project are set out in that project's signed proposal or agreement, not on this Site. Any budget ranges shown in forms or service pages are indicative only and not a fixed quote.
We treat information shared with us about your business and project as confidential, and are glad to sign a mutual NDA before detailed discussions if you'd like one. Details of specific client projects are only referenced publicly (for example, in case studies) with the client's agreement.
This Site and its content are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We don't guarantee the Site will be uninterrupted, error-free or secure at all times. Warranties relating to delivered project work, if any, are set out in the applicable project agreement.
To the fullest extent permitted by law, BuildStackSoftware will not be liable for indirect, incidental, special or consequential damages arising from your use of this Site. Liability arising from an actual project engagement is governed by the limitation of liability terms in that project's signed agreement.
You agree to indemnify and hold us harmless from claims, losses or expenses arising from your misuse of the Site or violation of these Terms.
The Site may link to third-party sites or services (for example, WhatsApp) that we don't control. We're not responsible for their content, policies or practices — review their own terms and privacy policies separately.
We may suspend or restrict access to the Site for anyone who violates these Terms. Termination of a specific project engagement is governed by that project's signed agreement.
These Terms are governed by the laws of India, without regard to conflict-of-law principles, and any dispute relating to the Site will be subject to the exclusive jurisdiction of the competent courts in India. Governing law for a specific project may be set separately in that project's agreement.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Site after changes take effect means you accept the updated Terms.
